Legal Avuncular DNA testing is a relationship DNA test used to determine whether an aunt or uncle and niece or nephew are biologically related. This testing option can be used in certain situations when a parent (father or mother) is unavailable to perform a direct parent-child DNA test for legal purposes.
DNA Testing requirements for legal cases:
Government-issued identity verification at the time of your appointment
Third-party DNA sample collection
Chain-of-custody documentation
Secure Results
Genetic analysis
DNA results issuance
Please note, failure to meet any of the above mentioned requirement will require re-collection of your DNA samples.
Although legal avuncular DNA testing is requested less frequently than legal paternity testing, there are several situations where establishing the biological relationship between a mother and child becomes important.
Common reasons include:
When an alleged father is deceased and did not sign an Acknowledgment of Paternity before his death, the Social Security Administration may allow sibling DNA testing when a direct father-child DNA test cannot be performed.
When a petitioner receives a Request for Evidence (RFE) from USCIS, the U.S. Passport Agency, a U.S. Embassy, or a U.S. Consulate, the requesting government agency may suggest voluntary DNA testing to help establish the claimed biological sibling relationship. This testing option is seldom requested by an immigration agency.
When an alleged father is deceased, sibling DNA testing may help establish a biological relationship for inheritance or probate matters when direct paternity testing is no longer possible.
Average turnaround time for results is two to three business days from the date in which the laboratory receives all DNA samples. Upon completion of the DNA analysis, a copy of your results will be mailed to your home and an additional copy will be emailed to you for your records.

The mother must be present when a child under the age of 18 is participating in a legal avuncular DNA test. If the child is 18 years of age or older, the child and aunt or uncle may complete the DNA test without the mother's consent.
When an aunt or uncle is the child's legal guardian, the mother is not required to be present for the DNA collection appointment.
Although the mother is not always required to participate, we recommend that she be included in the avuncular DNA test whenever possible. The mother's DNA helps strengthen the genetic comparison and may increase the overall accuracy of the DNA analysis.
