When Is Legal Sibling Test Necessary?

Although legal sibling DNA  testing is requested less frequently than legal paternity testing, there are several situations where establishing the biological relationship between a mother and child becomes important.

Common reasons include:

Adding a Name to a Birth Certificate

When an alleged father is deceased and no grandparents are available to participate in DNA testing, a legal sibling DNA test may be performed if another child of the alleged father is available for comparison. The results may help establish whether both individuals share the same biological father.

Social Security Benefits

When an alleged father is deceased and did not sign an Acknowledgment of Paternity before his death, the Social Security Administration may allow sibling DNA testing when a direct father-child DNA test cannot be performed.

Immigration Cases

When a petitioner receives a Request for Evidence (RFE) from USCIS, the U.S. Passport Agency, a U.S. Embassy, or a U.S. Consulate, the requesting government agency may suggest voluntary DNA testing to help establish the claimed biological sibling relationship.

Estate and Probate Matters

When an alleged father is deceased, sibling DNA testing may help establish a biological relationship for inheritance or probate matters when direct paternity testing is no longer possible.
